“Preventive suspension will keep the accused away from his bounden legislative duties and functions thereby depriving the constituents of his district a duly elected representative in Congress. The statute-dictated purpose of preventively suspending a public officer indicted of a graft-related offense cannot be more paramount than the popular will and interests of his constituents,” he said.
